CODE OF CONDUCT

Kaizen Academy is a Community of people from varying backgrounds, we don’t care where you were born, what you do for a living, where you live, what your personal preferences are or the like. However, we do have to have some scene of order in the Studio so that classes continue to run smoothly.

Before you consider the Code of Conduct below, you must frame them from the point of view of Our Values:

Conduct in the Studio (Instructors & Students):

- At all times, students must respect and obey the instructions of Instructors and other higher-ranking belts and show respect for the Studio.

- Instructors are to refrain from using harsh tones and language towards students, where possible they must be an example of good behaviour.

- Conduct yourself in a formal, respectful manner at all times when in the school.

- Do not interfere in any way with classes in progress.

- At no time engage in horseplay on the training areas or in the studio.

- Keep hands and feet off the walls and glass.

- Unnecessary roughness, swearing at people, or display of ill-temper is forbidden.

- Always observe mat etiquette in the training area, including bowing when entering or leaving the Studio and wearing an approved uniform in the training areas.

- No chewing gum or food is allowed on the mat or training areas.

- No one under the influence alcohol or a prohibited substance may train.

- Smoking is prohibited in the Studio.  

Conduct During Class:

- Prompt attendance is expected. If you are unavoidably late, follow the late procedure as directed. Wait at the edge of the mat wait for acknowledgement from the instructor before joining the class.

- Repeated late attendance (without reason) will result in not being allowed into class.

- All students must show proper respect to instructors and fellow students. This includes receiving feedback in a manner that conveys you understand and are willing to accept the feedback from the Instructor. Dismissive language will not be tolerated.

- During sparring and training students are to be careful not to make contact through neglect or carelessness. Contact due to carelessness is a serious offence.

- Speaking to your partner is important during training; however it must not get too loud and must stop when an Instructor is teaching.

- You may ask questions during class by raising your hand and waiting to be recognised.

- Contradicting instructors or complaining during class is strongly discouraged. Instructors are happy to discuss any issues individually away from the class.

- Instructors are to be addressed with their appropriate title. (It is formal etiquette to bow to your instructor before and after speaking with them, however that is the decision of the Instructor as to whether this is adhered to.)

- You may not leave the mat at any point during training without the explicit permission of the instructor.

- You may not chew gum, talk, swear, put your hands on your hips, or lean against the walls at any point during class. [This is old school]  ...

Conduct Outside the Studio:

- Always conduct yourself in a manner befitting your art and your club.

- Refrain from making critical comments about other styles, students or instructors.

- Always be polite and acknowledge fellow members if/when you meet them outside the club. (If you can’t remember their name, ask them – don’t pretend you didn’t see them. 🙂 )  

Information & Communication:

- In no circumstances are you to provide false or misleading information, this includes fake phone numbers, email addresses or other information that would make it difficult for someone to reach you or know who the information is coming from.

- Slander or Libel of Instructors, Members and/or the club is not appreciated and also puts you in a position where you could be sued. Think before you type or speak negatively.

- Kaizen Academy staff, like you, deserve a workplace free from verbal abuse, racism and sexism – any display of poor behaviour will result in immediate expulsion from the club and the cancellation policy taking effect.

CANCELLATION TERMS

We understand that not everyone can keep training with us forever. That’s life. In order to complete your cancellation, you will need to complete this form. CANCELATION FORM

Cancellation Policy Terms

- If you decide to reactivate your membership in the future (and we hope you do) membership rates in effect at the time of reactivation will be applicable as membership rates are subject to change – i.e. your old rate may no longer be available if prices have changed since you joined.

- If you are sure you’d like to cancel, please complete the form above. This will serve as your 14-day written cancellation notice as required by our membership terms and conditions. (If you emailed first, we will start the 14 days notice from that date – however you cancellation will NOT be processed until this form has been completed.)

- Pandemic/Epidemic Impact: It is also noted that this 14-day notice period will not be waived due to a Health Directive as other digital training solutions will be provided.

- No suspensions during Christmas/New Year/January Period – Parents please note, payments are worked out at weekly, fortnightly or monthly payments covering the full 12 months of the year. I.e. Monthly payments are calculated at 48 weeks of classes divided by 12 equal payments. Fortnightly is 48 weeks of classes divided by 26 equal payments.

- If you have a scheduled payment within this 14-day period, the payment will be processed as scheduled (This includes payments during a Membership Pause). All payments are non-refundable.  **To clarify all payments in full will be processed as per that schedule – meaning that no pro-rata payments will be made. You are welcome to adjust your cancellation date to reflect your payment frequency – if you wish – which would extend the cancellation date.

- All Cancellations MUST be put in via the form above to be considered valid requests. Emails, SMS, Comments to staff, or Facebook messages cannot be excepted.

SUSPENSION & INJURY POLICY

OUR SUSPENSION & INJURY POLICY WHAT WE OFFER

You can request to put your payments on hold for up to 6 weeks if you are injured or spending time out of town for work .

Note: This does not include the 2 week Christmas/NY period or training during January.  

REASONS FOR SUSPENSION

Please note what you can request a suspension for:

- If you are injured or unwell. A Medical certificate may be requested for return to training.

- If you are traveling for work.

Things you can not request a suspension for:

- Travel/Vacations You’d “just like a break” or  “we’re going away for a month over Christmas” (please see cancellation policy)

- You missed a few weeks, didn’t tell us, and want it applied retrospectively.

- Christmas/New Year/January periods  

You MUST let us know two weeks in advance (via email) of your hold period and we will arrange to suspend your payments. We’ll need a start and finish date as we will automatically to restart your membership when your hold period is complete. If you have a scheduled payment within this 14-day period, the payment will be processed as scheduled (This includes payments during a Membership Pause). All payments are non-refundable.  **To clarify all payments in full will be processed as per that schedule – meaning that no pro-rata payments will be made    

We can only put your membership on hold for a maximum of 6 weeks. A suspension of over 6-weeks will be processed as a cancellation – normal cancellation policy applies.  

PROMOTIONAL OR UPFRONT PLANS: When purchasing a promotional offer or an upfront plan with discounted rates, this excludes you from suspending your membership due to the discounts covering any missed training.  

PANDEMIC/QUARATINE SUSPENSIONS: Unfortunately the need for 7-14 days quarantine is not covered by our suspension policy. We appreciate the need for quarantine, noting that during that time we continue to run classes and your spot is maintained.  

CANCELLATIONS DURING SUSPENSIONS: (A.k.a. Soft Cancellation) Please note that cancellation during a period of illness/injury suspension does reactivate payments and the standard cancellation policy applies in this instance.

PRIVACY POLICY

SECTION 1 – WHAT DO WE DO WITH YOUR INFORMATION?

When you purchase something from our Studio, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.

When you browse our store and website online, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

Email marketing (if applicable): With your permission, we may send you emails about our Dojang, new products and other updates.

SECTION 2 – CONSENT

How do you get my consent?

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

How do I withdraw my consent?

NSW SECTION 3 – DISCLOSURE

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

SECTION 4 – STORAGE OF INFORMATION

Our websites, point of sale systems and customer relationship management software are all hosted on platforms with secure encryption.

Payment: All of our payments are processed through direct payment gateway to complete your purchases and membership, our provider (STRIPE) stores your credit card or bank account data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted unless it is stored for regular payments as agreed.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 5 – THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

SECTION 6 – SECURITY

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

Here is a list of cookies that we use. We’ve listed them here so you can choose if you want to opt-out of cookies or not.

lsitevisit, no data held, Persistent for 30 minutes from the last visit, Used by our website provider’s internal stats tracker to record the number of visits

lsiteuniq, no data held, expires midnight (relative to the visitor) of the next day, Counts the number of visits to a store by a single customer. cart, unique token, persistent for 2 weeks, Stores information about the contents of your cart.

storefront_digest, unique token, indefinite If the shop has a password, this is used to determine if the current visitor has access.

SECTION 7 – AGE OF CONSENT

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

SECTION 8 – CHANGES TO THIS PRIVACY POLICY

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

We use non explicit photo images or video taking during our training sessions as digital assets for social media and promotion.

By becoming or being a member, consent is assumed. If you do not with for your self or children in your care to have their photo or video used. Please confirm the students full name and inform us via email on [email protected]
